Welcome to the Handstamp, Inc. website and online services. We empower people to plan, promote, host, attend, and enjoy live experiences. To do this, we provide an online information and communications services including, but not limited to, subscription services, appointment and messaging service, chat, ticketing, and any other services provided on our website (https://www.handstamp.com/), the Handstamp mobile application, or any other platforms or services we offer (collectively referred to as the "Services"). This Agreement applies to anyone who accesses or uses our Services, regardless of registration or subscription status.
We make the Services available to you in exchange for your agreement with both the Privacy Policy below and our Terms of Service (collectively the "Agreement"). Handstamp, Inc. is the manager and operator of the Services and may be referred to below as “Handstamp”, "we", "us", or "our". Any person or entity accessing, using, or subscribing to part or all of the Services or attending an event by utilizing our Services, either directly or indirectly, is variously referred to as "you" or "your". If you are using the Services on behalf of a group or organization, you represent that you can and do agree to these Services on behalf of your group or organization and the terms “you” or “your” include your group or organization as well.
Please read the Agreement carefully since it is a legally binding agreement that includes information about your legal rights and responsibilities regarding the Services. By using the Services, you agree to the terms of this Agreement. By using this website, you signify that you accept this Agreement. If you do not accept this Agreement, you may not use or access the Services.
Also note that linked websites, software providers, payment processors, and other separate functionalities may be subject to additional or different privacy policies. By using these other sources, you agree to accept the privacy policy and other conditions that apply to these other companies and functionalities.
We collect personal data from you when you use or interact with us through the Services. We may do this by ourselves, or for an event promoter using our Services. The information we collect includes technical information about your device, as well as information about you.
Technological information we collect may include your IP address, internet and electronic network information, time zone and language preferences, information about the browser and device used (including hardware and software used) to access our Services, usage statistics, cookies, server logs, geolocation data, information for security and fraud prevention, other pages visited, and similar information used to provide you with a good experience while using our Services or assist with our work in analyzing or improving the Services we provide to you.
We and our service providers collect information using various programs, including cookies or web beacons. Cookies are small data files stored in your device that help us improve and track usage on our Services. Web beacons are electronic images that may be used by our Services, emails, or other communications to track Services usage and communications.
We also collect information you provide to us directly to use our Services. This includes the information provided when you create an account or event page, personalize an event page, send chat messages, fill out forms, or communicate with us. The types of information that we may collect include identification information such as your name, username, password, email address, phone numbers, mailing address, or social media accounts. You may provide personal information such as images, information about who transacts with you to buy or sell tickets, invitations, imported contacts if you choose to provide them, location information, demographics, interests, and other optional information.

When this happens, we treat this combination like personal data until such time as it can no longer be associated with you or used to identify you.
The information you give us when joining an event may imply information about your employment or profession, religion, union membership, political views, health conditions, or your sexual identity. We endeavor to protect these kinds of sensitive information pursuant to applicable law, but request you use caution when making these disclosures since other will be interacting with you through our Services and at events. You should not make other people's personal or sensitive information available through the Services without that person's permission.
We may collect information about you from other sources. We rely on these third parties to help provide our Services. You will have either consented to their information collection, or they will have taken steps to make sure they are legally allowed to disclose your information to us. Such groups include social media services when you link your account to the Services, payment processors for ticket sales, websites or other accounts where you create links to the Services, event organizers, or from other users of our Services who post images, text, or other content. While we do not collect credit card or other payment processing information, we will receive some information from these sources to be associated with you for the transfer of tickets. We may receive partial credit card numbers provided by third-party processors as they identify your purchase. We also may receive information from advertisers, third-party publishers, advertising networks or service providers managing advertisements on other websites, email and other communications providers, and other third parties. Please keep in mind that we do not control what information event organizers and other third parties may collect from you, and that you should review their terms of use or privacy policies, where available, prior to interacting with them.
We do not knowingly collect personal information from children under the age of thirteen years old pursuant to the Children's Online Privacy Protection Act. The age restrictions from our Terms of Use set the required age to use our Services. If you are less than this age, you are not allowed to use our Services and should not submit any personal information to us. We recommend parents our legal guardian monitor internet usage by children and help us keep this information off our Services. If you have reason to believe that a child under the age of thirteen years old placed personal information on our Services, please contact us immediately so we can work with you to investigate and address this concern.
We collect, and use the data we collect, in ways consistent with this Privacy Policy and applicable privacy laws. We use the information you provide us to provide, operate, analyze and monitor, secure, and improve our Services. This may include seeking or investigating unusual activity, addressing illegal or fraudulent activities, or other actions to protect your, our, or third-party rights, property, safety, and compliance with applicable laws or regulations.

We may use aggregated personal data for research, improvement or monitoring our Services, or to improve our Services and understand our customers better. Please note that when we aggregate data, we do not treat it as personal information. We may advertise our Services on third-party websites and social media platforms, which may be due to content that either we or the event promoter provides.
We may store your personal information ourselves or through third parties to whom we have transferred it in accordance with this Privacy Policy. We have taken technological measures, created internal policies, and included standard contractual clauses to protect your personal information in our Services. These include training employees regarding our data privacy policies and procedures, using firewalls to protect against intruders, and testing for network vulnerabilities. However, you accept and agree that no network, server, software, online service, database, communication, or electronic transmission is ever fully secure or error free. You are responsible for creating a strong password, keeping it secure and confidential, and not sharing it with others to avoid compromise of your information or other challenges with your account. We may retain certain information we collect from you, even after your account has been suspended or after you delete it, for certain business purposes. They may include ensuring we do not send you communications if you have asked us to stop, to provide accurate information to event promoters and others where applicable, for monitoring website traffic, for detecting and preventing misuse of our Services including illegal activities or breaches of the Agreement, where it has been aggregated or anonymized for particular uses, or for legal, compliance, accounting, or related business purposes.
If you are in a jurisdiction requiring a specific legal basis for processing personal data, this basis for collecting or using the information we receive will depend on the information and context of its collection. For example, we process information about you to provide the Services, facilitate your attendance of events or getting tickets, displaying your profile, sending or forwarding communications, or otherwise performing our contracts or Services. We may process information about you when it is in our legitimate interest to do so and not superseded by your rights. Some examples may include fraud prevention, security of our Services, responding to your communications, technical operations and management, improving our systems and Services, and sometimes sending marketing messages or other notifications.
While discouraged, you may provide us with sensitive personal information about your health, religion, employment or union membership, political views, sexual identity, or financial information. Attending events, sharing your interests, and communicating with others through our platform is entirely voluntary. Our legal basis for processing any of this sensitive information is often either that you explicitly consented to its publication or that you made it public yourself.
We may have legal or professional requirements to process information about you. These may include responding to inquiries from law enforcement, courts, regulatory, audit, legal or administrative demands. We may need to protect your or another person's interests.
We share some information that we collect from you on our Services based on your member profile and account settings. Some of this information, such as your name or username and content you upload may be public by default. Some information, such as events you plan to attend, may be public by default, but can be hidden on our Services. We recommend you check your settings and the information that will be made available before creating a profile or joining events, groups, social media fan pages. Information that is public through our Services may be visible to people using the Services as well as those outside our Services.
We may disclose, transfer, or share your personal data with certain third parties without further notice to you. Third parties may include social media services, event promoters or organizers, ticket vendors and other third parties who may receive some personal information from you as part of your ticket purchase or event attendance, your contacts if you make them available to us, service providers or contractors that help us with our Services or process personal data for us to perform business-related functions, or to advertisers. For example, when you connect our Services to a social media website, we may collect, use, disclose, transfer, store, share, or hold information relating to your account with such third-party services in accordance with this Privacy Policy. Our service providers include those helping us operate, monitor, or improve our Services such as information hosting or storage, email and text communications, advertising management, and other support.
We may also collect information from you if you follow us on social media websites, such as your name, email address, username, post content where applicable, or other information. Likewise, interacting with social media websites through the Services creates a link between the services and your browser and will transfer certain technical and identifying information to the social media service. Event promoters or organizers may use your personal information for notification or advertising purposes as well.

We may disclose personal information when required for legal, compliance, security, regulatory, or related reasons. You can access, modify, or delete information about you on our Services. As a registered user, you can make these changes through your account, either by editing it or deleting the account. These choices include your acceptance of cookies or related technologies collecting information through our Services, controlling how you receive electronic communications (including opting in or out of them), or managing the personal information you submit along with other content provided through our Services or other social media. We recommend responsible use of social media and content sharing. Please understand that certain functionalities of our Services may not be available to you without certain information provided.

When a user of our Services requests their information be deleted, we may do so even if it inconveniences or negatively affects the capabilities of event promoters or organizers. However, as a user of our Services you understand that your personal information may still be held by event organizers, promoters, or other third-party individuals or companies as we do not control their actions or activities. Please also understand that we may retain you information after such changes or removals to meet business, legal, or other regulatory requirements as stated earlier.
When receiving marketing or sales communications from us, you may opt out of receiving such communications by using the “Unsubscribe” link in the email message or providing the requested prompt through text message. You understand and agree that we will require time to process your unsubscribe requests, so you may receive additional electronic communications for a brief time after you opt out. You may manage some of your contact preferences through your account. Please note that communications from event promoters or organizers, ticket providers, social media platforms, and other third-party entities may send communications through our Services but are not governed by our internal procedures.

We will respond to your request based on applicable law and regulation. Residents of certain locations may have additional rights, so please be prepared to specify your area of residence as part of your request. Please also understand that we may require additional identification information from you as part of this process to protect your information from being accessed, changed, or deleted by another person or entity. Our Services, including our website, currently do not observe “Do Not Track” requests from your browser due to technical, logistical, and other business reasons.
We may modify this Privacy Policy from time to time. We will provide notice to you of any such changes by publishing the most current version on our Services with the new date at the top of the webpage page. Under the California Consumer Privacy Act ('CCPA'), a California resident ("you" or "your") has certain rights regarding how companies like Handstamp, Inc. ("we" or "our") manage personal information about you. These rights include your ability to request access or deletion of your personal information held by that business. You also have the right to request a business stop selling your personal information.

We may collect commercial information such as records relating to experiences attended. We may use personal identifiers to provide you with information or services you request, such as to facilitate getting tickets for an experience, review applications for registration for our Services, or to send you information.
We may use personal identifiers and commercial information for general website administration, such as for analysis, testing, optimization, record keeping, quality control, and providing content.
We may use personal identifiers, commercial information, and technical information to monitor use of our Services, as well as for security or marketing reasons.

If you opt-out of allowing us to share your personal information with others, we may still use aggregated and de-identified personal information so long as it does not readily identify you. You may not receive communications from us and may experience some changes when interacting with our website. You have the right to request disclosure about what categories of personal information we share, “sell”, or otherwise disclose for a business purpose about you. We may also retain your personal information to conclude any transactions that have not been completed or collect outstanding debts.

Please note that we will need to confirm your identity which may require additional information disclosures to make sure we do not respond to requests to delete your information from another person who should be able to authorize it.
To the best of our capabilities, we will not treat you differently just because you have exercised any of the rights you hold. This means we will not deny you a particular service or intentionally provide you with a different level or quality of services because you exercised any of your rights. You may experience some changes in your use of our website, which will have nothing to do with your exercise of your rights and would only be due to the absence of technical information used to optimize your interaction with our website.
